END USER LICENSE AGREEMENT  

APUSVISION END USER LICENSE AGREEMENT  
Effective: August 1, 2024

1. LICENSE GRANT  
1.1 A limited, non-exclusive, non-transferable license is granted to use the App and subscription services **on iOS devices running version 16.0 or later**.

## 2. SUBSCRIPTION TERMS  
2.1 **Auto-Renewal**:  
- Subscriptions automatically renew until canceled **at least 24 hours** before the renewal date via Apple Subscriptions.  
2.2 **Price Changes**:  
- We reserve the right to modify prices with **14 days’ prior notice** via in-app alerts or email. Continued use constitutes acceptance.  
2.3 **No Refunds**:  
- All fees are **non-refundable** without exception, including unused subscription periods.  

 

## 3. USER OBLIGATIONS  
3.1 **Prohibited Acts**:  
- Reverse engineering, account sharing, or circumventing payment systems;  
- Using App data for **official match adjudication**.  

 

## 4. TERMINATION  
4.1 We may terminate access for violations **without refund**, at our sole discretion.  

## 5. DISCLAIMERS & LIABILITY  
5.1 **Limitation of Liability**:  
- **Exclusions**: We exclude liability for:  
  - Indirect, incidental, or consequential damages (e.g., lost profits, data loss);  
  - Third-party actions (e.g., Apple payment system failures);  
  - Your misuse of the App.  
- **Non-Exclusions**: Nothing in this EULA limits our liability for:  
  - Death or personal injury caused by our negligence;  
  - Fraud or fraudulent misrepresentation.  
- **Reasonableness**: This limitation reflects the risks assumed by both parties and is fair under applicable law.  

 

## 6. GOVERNING LAW  
6.1 **Choice of Law**: This EULA is governed by Isle of Man law, excluding the UN Convention on Contracts for the International Sale of Goods.  
6.2 **Exclusive Jurisdiction**: Any claim must be brought solely in the courts of the Isle of Man. You irrevocably waive all jurisdictional defenses, including forum non conveniens.  

 

## 7. GENERAL  
### 7.1 Amendments  
- **Non-Material Changes**: We may modify this EULA for non-material changes (e.g., correcting typographical errors, updating links) without prior notice.  
- **Material Changes**: For material changes (e.g., price adjustments, feature modifications), we will provide **14 days’ prior notice** via in-app alerts or email. Continued use constitutes acceptance.  

### 7.2 Interpretation  
- APUSVISION retains sole authority to interpret the terms of this EULA. Your agreement constitutes acceptance of our interpretation as final and binding.  

### 7.3 Acceptance  
- By checking “I Agree” during registration, you bind yourself to this EULA. Continued use implies acceptance of updates.
